DMCA Notice & Takedown Policy

Effective Date: January 12, 2026

HARBCO Realty (“HARBCO,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects visitors and users of our website to do the same. In accordance with the Digital Millennium Copyright Act (the “DMCA”), we will respond to properly submitted notices of alleged copyright infringement that comply with the DMCA.

1) How to Report Copyright Infringement (DMCA Notice)
If you believe that content available on or through this website infringes a copyright you own or control, you may submit a written DMCA notice to our Designated Copyright Agent.
To be effective, your notice must include all of the following:

  1. Your physical or electronic signature (typing your full legal name is typically sufficient for an electronic signature).

  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list).

  3. Identification of the allegedly infringing material and information reasonably sufficient to permit us to locate it (for example: the exact URL(s) on our website).

  4. Your contact information, including name, mailing address, telephone number, and email address.

  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.

  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

3) What Happens After We Receive a Valid Notice
After receiving a complete and valid DMCA notice, HARBCO may remove or disable access to the allegedly infringing content and may take reasonable steps to notify the party associated with the content (if applicable). We may request additional information if your notice is incomplete.

4) Counter-Notification (DMCA Counter-Notice)
If you believe material was removed or disabled due to mistake or misidentification, you may submit a counter-notification to the Designated DMCA Agent by email only at info@harbcorealty.com.
Your counter-notice must include:

  1. Your physical or electronic signature.

  2. Identification of the material that has been removed or disabled and the location where it appeared before removal (e.g., the URL).

  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.

  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, the jurisdiction of any judicial district in which HARBCO may be found), and that you will accept service of process from the person who submitted the original DMCA notice or their agent.

Upon receipt of a valid counter-notice, we may forward it to the original complaining party. If the original complaining party does not file a court action within the time required by the DMCA, we may restore the removed content.

5) Repeat Infringer Policy
In appropriate circumstances and at our discretion, HARBCO may limit access to this website or terminate relationships with individuals or entities who are determined to be repeat infringers.

6) No Legal Advice; Misrepresentations
This policy is provided for informational purposes and does not constitute legal advice. Under the DMCA, any person who knowingly materially misrepresents that material is infringing (or that material was removed or disabled by mistake) may be subject to liability.

  • The statement of good faith belief (Section 1, item 5)

  • The statement under penalty of perjury (Section 1, item 6)

  • Your electronic signature (type your full legal name)
